The branch
You would like your company to exercise all or part of its activities in Belgium. You have chosen your operating address and appointed the person responsible for representing you here in Belgium. Your company is expanding to a foreign country but you do not wish to create a company under Belgian law: you are creating a branch.
Conditions
- A regular activity in Belgium
- An address
- A person in charge, capable of making commitments in respect of third parties on behalf of the foreign company.
Formalities
- Decision by the general meeting of your company to open a branch, specifying the outlines of the activity and the powers of the person authorised to represent it in Belgium.
- Publication in the Moniteur belge (Belgian official journal) of the minutes recording this decision.
- Checking access to the profession
- Applying for an itinerant activities permit / fairground activities permit
- Registration with the Banque-Carrefour des Entreprises (central business database) and allocation of a business number
- Identification with the VAT authorities
- Application for all other permits required for certain activities
- Affiliation to the social status of a self-employed person and affiliation of your company
- Affiliation to our social secretariat (payroll administrator) and our family allowance fund if you take on staff
